The Department of Environmental Protection (DEP) will temporarily allow portable restrooms, mobile restrooms, mobile shower trailers, and portable or stationary holding tanks at events like:
- Fairs
- Carnivals
- Revivals
- Field locations
- Encampments
- Other places without permanent structures where people gather for short periods of time.
These systems must meet the general rules of Chapter 62-6.0101 F.A.C.
Portable restrooms and holding tanks must be available at commercial and residential construction sites whenever workers are present. They are not bound by the definition of temporary. They may stay in use for the duration of construction as outlined in Rule 62-6.0101(7)(a) F.A.C
All stationary holding tanks must meet the construction standards in Rule 62-6.013 F.A.C.
Important Note: The Onsite Sewage Treatment and Disposal System Construction Permit (DH 4016) is required before installing any portable restroom or stationary holding tank for permanent use.
An applicant for a holding tank installation permit must submit the following to the Florida Department of Health in Lee County (DOH-Lee):
- A completed application form (DH 4015).
- A copy of a contract with a permitted disposal company stating the holding tank capacity.
- A site plan including the proposed location of the holding tank in proximity to all surrounding features (potable waterlines, surface water, building, driveway).
- The scheduled pumping frequency. Holding tanks must be pumped at least weekly to prevent unsanitary conditions.
- The permit fee for a holding tank is $230.00 and includes review, permit, and inspection.

The company providing these restrooms or tanks must maintain them and remove them if regular facilities become available. They must be always available when people need them.
Size determinations for holding tanks are as follows:
